If your group health plan was in effect as of March 23, 2010—the day the Affordable Care Act took effect—it is “grandfathered.” That means it is exempt from many requirements included in the Affordable Care Act and also considered “qualified coverage” that meets the mandate to provide health insurance that begins January 2015.
You may add employees and dependents to the policy without losing grandfather status. However, if you make substantial changes, such as increasing employee contributions to premiums or decreasing covered services, your plan could lose its grandfathered status.
